FOI 0294 2019/20: Disciplinary Cases

Freedom of Information Request: 0294 2019/20

Please provide the following information about the disciplinary cases under MHPS in your organization for the financial year 2017/18:

  1. The number of permanent and locum doctors employed by the Trust (Headcount) 2434
  2. The number of concerns raised under MHPS by type of concern (the following is a suggested categorisation of the types of concern). Please allocate the cases to the most relevant type of concern.
Type of concern No. of concerns raised No. of formal investigations
    Doctor’s health
    Clinical competence
    Conduct
    Professional performance
    Criminality

The Trust does hold information on the number of concerns raised under MHPS by type of concern, but we are withholding this information under Section 40 of the Freedom of Information Act as the data is limited, and it may be possible to identify a doctor.

We have therefore categorised the concerns into Conduct and Capability – please see below.

Conduct 14 cases
Capability   8 cases

Please note that these figures only refer to cases formally investigated, as there will be concerns raised informally which aren’t collated centrally.

3. The outcome of formal investigations. Please provide the data on the outcome of formal investigations according to the following table:

Type of concern No further action Advice/warning Referral to the GMC Suspension Dismissal Resignation within 6 months of concern raised No outcome/ongoing as of the 31st March 2018 Stopped using through agency
Conduct  1  4  1 1 6 1
Capability  1  1     6

4. If the information requested in 2. and 3.  is set out in the report referred to in the second paragraph of the Background above, please just send me a copy of that report instead. Not Applicable

5. Please send me your Trust’s Disciplinary policy for dealing with concerns raised about doctors, the staff code of conduct, and the number of staff formally trained to handle concerns under MHPS.

244 staff are formally trained to handle MHPS concerns.

The Trust is withholding this information (Policy for Maintaining High Professional Standards in the Modern NHS, Staff Code of Conduct) under Section 21 of the Freedom of Information Act, as the information is publically available on the Trust website, please visit:
