5. How much do Bounty currently pay per annum for this service?

The Trust doesn’t directly make any money from the Bounty Contract. Bounty makes a donation to the Trust Charity that supports maternity services.

The sharing of this commercially sensitive information may mean the Trust breaching its contracts with Bounty but more importantly may prejudice Bounty’s and the Trust’s commercial interests.

The Trust is relying on FOI exemption:
Section 41 (1)
“Information is exempt information if –
It was obtained by the public authority from any other person (including another public authority), and
The disclosure of the information to the public (otherwise than under this Act) by the public authority holding it would constitute a breach of confidence actionable by that or any other person.”

Section 43 (2)
“Information is exempt information if its disclosure under the Act would or would be likely to prejudice the commercial interests of any person (including the public authority holding it).”
