FOI QEHB 0095 – Settlement Agreements

University Hospitals Birmingham NHS Foundation Trust (UHB) completed a merger by acquisition of Heart of England NHS Foundation Trust (HEFT) on 1st April 2018.  For the purposes of this request we have answered on behalf of the pre-merger UHB i.e. Queen Elizabeth Hospital.

1. The total number of settlement agreements for the financial years:

2015/16 – 62

2016/17 – 61

2017/18 – 72

2. The total costs associated for each settlement agreement in each financial year. This includes, but is not limited to, a payment of salary, payment in lieu of a notice period and payment of compensation for loss of office (Note: Do not include solicitors fees, just the amount the trust has paid out to the individuals).

2015/16 – Public Liability Claims £9,000, Employer Liability Claims £113,590, Clinical Negligence Claims £1,747,310.

2016/17 – Public Liability Claims £5,700, Employer Liability Claims £90,487, Clincial Negligence Claims £3,042,582.

2017/18 – Public Liability Claims £128,481, Employer Liability Claims £33,512, Clincial Negligence Claims £6,657,019 Employer Settlement Agreements £42,685.70.

The settlement agreements we require are those including: employer liability claims, public liability claims, clinical negligence claims and or all tribunals but not limited to just these.

We would also like to include all compromise agreements, severance agreements and would also include those under the MARS Scheme if you us the scheme for redundancy situations.
