The Trust does hold the information for questions 2 and 3. However we estimate that compliance with your request would exceed the appropriate costs limit under section 12 of the Freedom of information Act 2000. This is currently £450. The appropriate limit would be exceeded if it would require more than 18 hours work.
Whether or not the patient associated with an incident reported on the Trust’s incident management system or on STEIS had a learning disability is not routinely captured information. In order to identify whether the incident did relate to a patient with a learning disability, an member of staff would have to manually review every NRLS record and STEIS record referring to a patient death, in addition to the patient’s medical records, to ascertain whether the affected patient had a learning disability. We estimate that this would exceed 18 hours.
We are therefore withholding this information under section 12 of the Freedom of Information Act.
